Terms & conditions

These terms and conditions ("Terms") govern the sale of handmade ceramic goods through this website by Trgovina na stojnicah Nika Horjak s.p. ("we", "us", "the studio"). They are drafted in accordance with the Slovenian Consumer Protection Act (ZVPot) and EU Distance Selling Directive (2011/83/EU).

The studio is not VAT-registered (Article 94, paragraph 1 ZDDV-1).

2 · The pieces

Every piece is hand-thrown or slab-built in our studio in Piran, Slovenia, then glazed and fired in a small kiln. Because each piece is made by hand:

• Slight variations in glaze tone, surface texture and form are inherent and not defects.
• Stated dimensions are approximate (±10 %).
• Photographs are representative; the piece you receive will look very similar but not identical.

3 · Pricing

All prices are in EUR, displayed without VAT (the studio is not VAT-registered). Shipping costs are added at checkout and shown clearly before you confirm payment. Prices may change without notice but the price valid at the time you placed the order is the price you pay.

4 · Ordering

Placing an order through our website constitutes a binding offer to purchase. We confirm receipt of your order by email — this email is a confirmation of receipt, not yet a binding sales contract. The contract is formed when we send you the dispatch confirmation email.

We reserve the right to refuse or cancel any order at our sole discretion (e.g. obvious pricing error, suspicion of fraud, item unavailable due to kiln loss).

5 · Payment

Payment is processed via Stripe, an Irish-licensed payment service provider. When you click "Buy this piece", you are redirected to Stripe's secure, PCI-compliant hosted checkout. Accepted methods include major credit and debit cards (Visa, Mastercard, American Express) and local payment methods (Apple Pay, Google Pay, SEPA, Bancontact, iDEAL) depending on your country. The studio never sees or stores your card data.

6 · Delivery

Where we ship

• Slovenia — flat rate, 1-3 business days.
• Rest of EU — flat rate, 3-7 business days. Free shipping on orders over €100.
• Rest of world — calculated at checkout, 5-14 business days. Customs duties may apply (paid by the recipient).

How we ship

Each piece is wrapped by hand in raw linen, then double-boxed in recycled card with paper shred. Orders are dispatched within 2-4 business days from our studio in Piran via Pošta Slovenije, GLS or DHL Express depending on destination.

Risk of loss

Risk of loss passes to the buyer upon delivery. All shipments are insured — see "Breakage" below.

7 · Right of withdrawal (14-day return)

Under EU consumer law, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you (or a third party other than the carrier indicated by you) acquire physical possession of the goods.

To exercise the right of withdrawal, send us a clear statement (by email) of your decision to withdraw. You may use the model withdrawal form below.

You must return the goods to us within 14 days of communicating your withdrawal. The cost of returning the goods is your responsibility. We will reimburse all payments received from you (including original shipping cost, except any extra expedited-shipping option you chose) within 14 days of receiving the returned goods, using the same payment method as the original payment.

You are responsible for any diminished value of the goods resulting from handling other than what is necessary to establish the nature and characteristics of the goods.

8 · Breakage during shipping

If a piece arrives broken or damaged in transit, we will replace or refund it free of charge — anywhere in the world. Within 7 days of delivery, send us a photograph of the damage at lobo.dar@gmail.com. You do not need to return the broken piece.

9 · Defects & warranty

The statutory consumer warranty under ZVPot applies: pieces must conform to the description and be free from manufacturing defects. You may notify us of any defect within 2 years of delivery. Slight natural variations (glaze speckles, throwing rings, fingerprint on the foot) are not defects — they are characteristic of handmade stoneware.

Pieces are dishwasher- and food-safe unless otherwise noted on the product page. They are not microwave-tested or oven-tested; please treat them as decorative tableware.

10 · Out-of-stock & made-to-order

Because everything is made in small batches, occasionally a piece you order may sell out before fulfilment. In that case we will email you within 2 business days to offer either: (a) wait for the next kiln batch (typically 1-2 weeks), or (b) a full refund. The choice is yours.

11 · Consumer redress in the EU

The European Commission's online dispute-resolution platform was discontinued on 20 July 2025. EU consumers can now find national dispute-resolution bodies and consumer-redress information at consumer-redress.ec.europa.eu. We are not obliged to participate in extra-judicial dispute resolution before a consumer arbitration board, but we will work in good faith to resolve any concerns directly.

12 · Governing law & jurisdiction

These Terms are governed by the laws of the Republic of Slovenia, excluding the UN Convention on Contracts for the International Sale of Goods. The courts of Koper, Slovenia have exclusive jurisdiction — unless mandatory consumer protection rules in your country of residence give you the right to bring proceedings there.

13 · Changes to these Terms

We may update these Terms from time to time. The version in force at the moment you place an order applies to that order. The current version is always available on this page.
